Adoption in Islam

It is not only childless couples who choose to adopt, many couples with children choose to adopt either family members or orphans to nurture and take care of. Looking after a child as well as arranging for his\her education and well being is an admirable thing. However it should be kept in mind that by adopting a child his/her lineage does not change according to Shari'ah. The purpose of this discussion is to explain the laws concerning the adoption of children. These laws should be adhered to at all times and under all conditions. By doing this the adoptive parents will ensure that the rights of the adopted child are not transgressed and in so doing the act of adoption will become most beneficial to the parents.

The Meaning of Qalb-e-Saleem

Nabi Ibrahim u described the day of Qiyaamah as:  “The day when wealth and children will not benefit anyone except he who will come to Allah with a Qalb-e-Saleem.”  (Surah Shu’ara, Aayah 38-39).  Thus Ibn Rajab (R.A.A.) mentions in his commentary of Imam Nawawi (R.A.A.)’s Forty Ahaadith that our beloved Nabi Muhammad e used to say in his Du’aa:  “O Allah!  I ask you for a Qalb-e-Saleem....”

The Mujtahideen and Hadeeth
Many people, due to ignorance of the Shari'ah, criticize the A'immah e Mujtahideen saying that their rulings often contradict the Ahaadith of Rasulullahe.  Hafiz Ibni Taymiyyah(R.A.) has written a short treatise entitled Raf'ul Malaam 'anil A'immatil A'laam in which he mentions ten reasons why the ruling of an Imaam may sometimes seem contrary to a Hadeeth.  The following is a summary of the ten reasons together with a few additional notes...

Complaints

 The Jaahil (ignorant man) complains of Allah to the people.  He behaves in this manner due to his extreme ignorance of the being about whom he is complaining and the being to whom he is complaining.  If he recognised         his Rabb, he would have never complained about Him...
